Acceptable Use Policy

This Socialhose Acceptable Use Policy ("AUP") applies to the use of any product, service or website provided by us (Socialhose), whether we provide it directly or use another party to provide it to you (each, a "Socialhose Service"). This AUP is designed to ensure compliance with the laws and regulations that apply to the Socialhose Service.

This AUP also protects the interests of all of our clients and their customers, as well as our goodwill and reputation. These terms are so important that we cannot provide the Socialhose Service unless you agree to them. By using the Socialhose Service, you are agreeing to these terms.

If you are using any Socialhose Service, this AUP applies to you. Every client of ours agrees to abide by this AUP and is responsible for any violations. You are not allowed to assist or engage others in a way that would violate this AUP. We will enforce and ensure compliance with this AUP by using methods we consider to be appropriate, such as complaint and email failure monitoring. We may also suspend or terminate your use of Socialhose Services pursuant to our Terms of Service for violations of this AUP.

We periodically update these terms and we will let you know when we do through the Socialhose portal used to access your subscription (if you have one), or by posting a revised copy on our website. You agree to review the AUP on a regular basis and always remain in compliance.

1. Reporting Suspected Violations

We encourage recipients of email messages sent using the Socialhose Service to report suspected violations of this AUP to us by forwarding a copy of the received email with FULL headers to abuse@socialhose.net. We have a policy to investigate all of these reports and to respond in the way we consider appropriate.

If you know of or suspect a violation of this AUP, you will promptly notify us in writing of the known or suspected violation of this AUP.

1.1 Investigation Process

Upon receiving a report of suspected violation, we will:

  • Acknowledge receipt of the report within 24 business hours
  • Investigate the matter using reasonable methods and resources
  • Take appropriate action based on the severity and nature of the violation
  • Notify the reporting party of the outcome when appropriate and permitted by law

1.2 Cooperation

Users agree to cooperate with any investigation of suspected violations, including providing access to relevant account information, logs, and communications as reasonably requested by Socialhose.

2. Prohibited Email Actions

You may not use Socialhose to send spam. Spam can be in the form of bulk email or one-to-one commercial emails.

2.1 Definition of Spam

Bulk email is spam when it is unsolicited. Unsolicited means the recipient has not granted verifiable permission for the message to be sent. Bulk means that the message is sent as part of a larger collection of messages that have substantively similar content.

Alerts and Newsletter emails are spam when they violate CAN-SPAM. Alerts and Newsletter emails are also considered Spam if the data processed for purposes of sending that email is in scope of the General Data Protection Regulation ('GDPR') and you fail to provide notice to individuals and establish a lawful basis of processing.

2.2 Prohibited Activities

You may not use the Socialhose Service in any way (directly or indirectly) to send, transmit, handle, distribute, or deliver:

  • Spam in violation of the CAN-SPAM Act or any other law
  • Email to an address obtained via Internet harvesting methods or any surreptitious methods (e.g., scraping or harvesting)
  • Email to an address that is incomplete, inaccurate, and/or not updated for all applicable opt-out notifications
  • Commercial electronic messages in violation of Canada's Anti-Spam Legislation (CASL)
  • Communications in violation of the General Data Protection Regulation (GDPR)
  • Communications in violation of the California Consumer Privacy Act (CCPA)

2.3 Email Content Restrictions

You may not use any misleading or false names, addresses, email address, or subject line.

Email sent, or caused to be sent to or through the Socialhose Service may not:

  • Use or contain invalid or forged headers
  • Use or contain invalid or non-existent domain names
  • Employ any technique to otherwise misrepresent, hide, or obscure any information in identifying the point of origin or the transmission path
  • Use other means of deceptive addressing
  • Use a third party's internet domain name without their consent, or be relayed from or through a third party's equipment without the third party's permission
  • Contain false or misleading information in the subject line or otherwise contain false or misleading content
  • Fail to include a valid physical mailing address for the sender

3. Email Opt-Out Requirements

3.1 Unsubscribe Mechanism

All commercial email communications sent through the Socialhose Service must include a clear, conspicuous, and functioning unsubscribe mechanism that allows recipients to easily opt out of future communications.

  • The unsubscribe link must be clearly visible and easy to find
  • The opt-out process must be simple and not require more than one step beyond clicking the link
  • The unsubscribe mechanism must remain active for at least 30 days after the email is sent

3.2 Processing Opt-Out Requests

You must honor opt-out requests promptly:

  • CAN-SPAM: Process opt-out requests within 10 business days
  • CASL: Process opt-out requests within 10 business days
  • GDPR: Process withdrawal of consent without undue delay
  • Best Practice: We recommend processing opt-outs within 24-48 hours

3.3 Suppression Lists

You must maintain and use suppression lists to ensure that opted-out recipients do not receive further communications. You are responsible for:

  • Maintaining accurate and up-to-date suppression lists
  • Applying suppression lists to all email campaigns before sending
  • Not sharing suppression list data with third parties except as required by law
  • Retaining suppression data for the duration of your relationship with Socialhose and as required by law

3.4 Preference Centers

Where applicable, provide recipients with preference centers that allow them to:

  • Choose the types of communications they wish to receive
  • Adjust the frequency of communications
  • Update their contact information
  • Fully unsubscribe from all communications

4. No Disruption

4.1 Service Integrity

You may not use the Socialhose Service in any way that could damage, disable, overburden, or impair any Socialhose server, or the networks connected to any Socialhose server, or interfere with any other party's use and enjoyment of the Socialhose Service.

4.2 Prohibited Technical Activities

You may not:

  • Attempt to gain unauthorized access to the Socialhose Service, other accounts, computer systems, or networks connected to any Socialhose server
  • Probe, scan, or test the vulnerability of any system or network, or breach any security or authentication measures
  • Interfere with or disrupt the Socialhose Service or servers or networks connected to the Socialhose Service
  • Use any automated system, including "robots," "spiders," "offline readers," etc., to access the Socialhose Service beyond authorized API usage
  • Introduce viruses, worms, Trojan horses, or other malicious code
  • Attempt to reverse engineer, decompile, or disassemble any portion of the Socialhose Service
  • Use the Socialhose Service to attack, disrupt, or interfere with any third-party services or systems

4.3 Rate Limits and Resource Usage

You must respect API rate limits and resource usage guidelines as specified in our documentation. Excessive or abusive usage that impacts service availability for other users is prohibited.

4.4 Reporting Security Vulnerabilities

If you discover a security vulnerability in the Socialhose Service, please report it responsibly to security@socialhose.net rather than exploiting it or disclosing it publicly.

5. Proper Usage of the Socialhose Service

5.1 Lawful Purposes Only

The Socialhose Service may only be used for lawful purposes. You are responsible for ensuring that your use of the service complies with all applicable local, state, national, and international laws and regulations.

5.2 Prohibited Content and Activities

You may not use the Socialhose Service to monitor, collect, store, or distribute content that:

  • Is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Promotes illegal activities or harm against any individual or group
  • Contains child sexual abuse material or content that exploits minors
  • Promotes violence, terrorism, or extremism
  • Infringes on any patent, trademark, trade secret, copyright, or other proprietary rights
  • Violates the privacy or publicity rights of any third party
  • Contains malware, viruses, or other harmful code
  • Constitutes phishing or attempts to obtain sensitive information through deception

5.3 Data Collection and Privacy

When using Socialhose to collect and analyze social media data, you must:

  • Comply with the terms of service of all monitored platforms
  • Respect the privacy rights of individuals whose content is collected
  • Implement appropriate data protection measures
  • Not use collected data for harassment, stalking, or intimidation
  • Not use collected data to discriminate against individuals or groups
  • Maintain appropriate retention periods and delete data when no longer needed

5.4 Competitive Use

You may not use the Socialhose Service to develop or enhance a competing product or service, or for benchmarking or competitive analysis purposes without our prior written consent.

5.5 Account Sharing

Account credentials are personal to the registered user. You may not share your login credentials with unauthorized individuals or allow others to access your account. Organization accounts may have multiple authorized users as permitted by your subscription plan.

5.6 Compliance with Export Laws

You may not use the Socialhose Service in violation of any applicable export control laws or sanctions regulations. You represent that you are not located in a country subject to U.S. embargo and are not on any U.S. government list of prohibited or restricted parties.

6. Socialhose Trademark Use

6.1 Trademark Ownership

"Socialhose" and all related logos, product and service names, designs, and slogans are trademarks of Socialhose or its affiliates. All other names, logos, product and service names, designs, and slogans on the Socialhose Service are the trademarks of their respective owners.

6.2 Permitted Use

You may use the Socialhose name and trademarks only:

  • To truthfully identify Socialhose as your service provider
  • In accordance with any brand guidelines we provide
  • With our prior written permission for any other uses

6.3 Prohibited Trademark Use

You may not:

  • Use Socialhose trademarks in any way that suggests endorsement or sponsorship without permission
  • Use Socialhose trademarks as part of your own product or service name
  • Modify, distort, or alter Socialhose trademarks
  • Use Socialhose trademarks in a manner that disparages Socialhose or its products and services
  • Register or use any domain name, social media handle, or other identifier that contains or is confusingly similar to Socialhose trademarks

6.4 Attribution

When referencing Socialhose in written materials, you should include the appropriate trademark symbol (TM or ®) on first use and include an attribution statement such as: "Socialhose is a trademark of Socialhose."

7. General Terms

7.1 Enforcement

We reserve the right to investigate any violation of this AUP and take appropriate action, which may include:

  • Issuing a warning
  • Temporarily suspending access to the Socialhose Service
  • Permanently terminating your account
  • Removing or disabling content
  • Reporting violations to law enforcement authorities
  • Pursuing legal action for damages and injunctive relief

7.2 Severity of Violations

The severity of our response will depend on the nature and circumstances of the violation, including:

  • Whether it is a first-time or repeat offense
  • Whether it appears to be intentional or negligent
  • Whether the conduct is ongoing or has been corrected
  • The scope and impact of the violation
  • Legal requirements and third-party requests

7.3 No Liability for Enforcement Actions

We shall not be liable to you or any third party for any enforcement actions taken pursuant to this AUP. You acknowledge that such actions are necessary to protect the Socialhose Service and other users.

7.4 Indemnification

You agree to indemnify and hold harmless Socialhose and its officers, directors, employees, and agents from and against any claims, damages, losses, and expenses arising out of or related to your violation of this AUP, including reasonable attorneys' fees.

7.5 Relationship to Terms of Service

This AUP is incorporated into and subject to our Terms of Service. In the event of any conflict between this AUP and the Terms of Service, the Terms of Service shall control unless this AUP specifically provides otherwise.

7.6 Updates to This Policy

We may update this AUP from time to time. We will notify you of material changes by posting the updated policy on our website and updating the "Last Updated" date. Your continued use of the Socialhose Service after such changes constitutes your acceptance of the revised policy.
