We at Socialhose are committed to protecting your privacy. This Privacy Policy applies to the information and data collected by Socialhose as a controller, including the information collected on our Websites (socialhose.net and app.socialhose.net) or through other channels as described below.

This Privacy Notice describes how we collect, receive, use, store, share, transfer, and process your personal information. It also describes your choices regarding use, as well as your rights of access and correction of your personal information. If you do not agree with the data practices described in this Privacy Policy, you should not use the Websites.

This Privacy Policy does not apply to the data Socialhose processes on behalf of our customers (Customer Data) in our capacity as a processor. Your use of the Socialhose Subscription Service (the "Subscription Service") as a customer of Socialhose, including use of our associated platforms, is covered under our Service Agreement and Data Processing Agreement.

We periodically update this Privacy Policy. We will post any privacy policy changes on this page and, if the changes are material, we will provide a more prominent notice by sending you an email notification, or if you subscribe to the Subscription Service, through the Notification app in your Socialhose portal.

While we will notify you of any material changes to this Privacy Policy prior to the changes becoming effective, we encourage you to review this Privacy Policy periodically. We will also keep prior versions of this Privacy Policy in an archive for your review.

1. What Information We Collect About You

Our Use of the Subscription Service

We use our own Subscription Service to build webpages that people can visit to learn more about Socialhose. Information that we collect and manage using the Subscription Service for our own marketing belongs to us and is used, disclosed and protected according to this Privacy Policy.

When You Visit our Websites

You are free to explore the Websites without providing any Personal Information about yourself. When you visit the Websites or register for the Subscription Service, we request that you provide Personal Information about yourself, and we collect Navigational Information.

"Personal Information"

We collect personal information from you when you submit web forms or interact with our Website, for example subscribing to a Socialhose newsletter, signing up for a webinar, or requesting customer support. We also collect personal information when you sign up for a Socialhose account.

"Personal Information" refers to any information that identifies you personally, including contact information, such as your name, e-mail address, company name, address, phone number, and other information about yourself or your business. Personal Information can also include information about any transactions, both free and paid, that you enter into on the Websites, and information about you that is available on the internet, such as from Facebook, LinkedIn, Twitter and Google, or information that we acquire from service providers.

Personal Information includes Navigational Information or Payment Information where such information can directly or indirectly identify an individual.

"Navigational Information"

Navigational Information refers to information about your computer and your visits to the Websites such as your IP address, geographical location, browser type, referral source, length of visit and pages viewed. Please see the "Cookies and Similar Technologies" section below for more information.

"Payment Information"

Payment Information includes information we collect and process from you when you subscribe to the Subscription Service, including credit card numbers and billing information, using third party PCI-compliant service providers. Except for this, we do not collect other Sensitive Information from you.

"Sensitive Information"

This refers to credit or debit card numbers, financial account numbers or wire instructions, government issued identification numbers.

Information from Third Parties

We may receive information about you from third parties, including business partners, marketing partners, social media platforms, and publicly available sources. This may include information about your company, job title, industry, and other professional information.

2. How We Use Information We Collect

Compliance with Our Privacy Policy

We use the information we collect only in compliance with this Privacy Policy. Customers who subscribe to our Subscription Services are obligated through our Service Agreement to comply with all applicable laws concerning privacy and data protection.

We Never Sell Personal Information

We will never sell your Personal Information to any third party.

Use of Personal Information

We use your Personal Information to:

  • Provide and operate the Subscription Service and fulfill our contractual obligations
  • Process your subscription payments and manage your account
  • Send you important service communications, including confirmations, invoices, technical notices, updates, security alerts, and support messages
  • Respond to your comments, questions, and requests, and provide customer service
  • Communicate with you about products, services, offers, promotions, rewards, and events offered by Socialhose and others, and provide news and information we think will be of interest to you

  • Detect, investigate, and prevent fraudulent transactions and other illegal activities, and protect the rights and property of Socialhose and others
  • Personalize and improve the Services, and provide content or features that match your profile or interests

  • Comply with applicable laws, regulations, and legal processes

Use of Navigational Information

We use Navigational Information to operate and improve the Websites and the Services. We may also use Navigational Information alone or in combination with Personal Information to provide you with personalized information about Socialhose.

Customer Testimonials and Comments

We post customer testimonials and comments on our Websites, which may contain Personal Information. We obtain each customer's consent via email prior to posting the customer's name and testimonial.

Security of Your Personal Information

We maintain commercially reasonable administrative, technical, and physical safeguards designed to protect the security, confidentiality, and integrity of Personal Information. Such measures include:

  • Encryption of data in transit using TLS 1.2 or higher and at rest using AES-256 or equivalent
  • Multi-factor authentication for administrative access
  • Regular vulnerability assessments and penetration testing
  • Access controls based on the principle of least privilege

3. How We Share Information We Collect

Service Providers

We employ other companies and people to provide services to visitors to our Websites, our customers, and users of the Subscription Service, and may need to share your information with them to provide information, products, or services to you. Examples may include processing credit card payments, sending email, analyzing data, providing marketing assistance, and providing customer service. In all cases where we share your information with such agents, we explicitly require the agent to acknowledge and adhere to our privacy and customer data handling policies.

Socialhose Partners

In addition, we may share data with trusted partners to help us perform statistical analysis, send you email or postal mail, provide customer support, or arrange for deliveries. All such third parties are prohibited from using your personal information except to provide these services to Socialhose, and they are required to maintain the confidentiality of your information.

Corporate Events

If we (or our assets) are acquired by another company, whether by merger, acquisition, bankruptcy, or otherwise, that company would receive all information gathered by Socialhose on the Websites and the Subscription Service. In this event, you will be notified via email and/or a prominent notice on our Website of any change in ownership, uses of your Personal Information, and choices you may have regarding your Personal Information.

Compelled Disclosure

We reserve the right to use or disclose your Personal Information if required by law or if we reasonably believe that use or disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or comply with a law, court order, or legal process. Where legally permitted, we will provide you with notice of such disclosure and cooperate in seeking protective measures.

Aggregated and De-Identified Data

We may create and use aggregated, anonymized, and de-identified data derived from your use of the Services for purposes of improving the Services, benchmarking, and industry analysis, provided that such data cannot reasonably be used to identify you or any individual.

4. How We Transfer Information We Collect Internationally

International Transfer

Socialhose is a United States company with operations in the United States. If you are located outside of the United States, please be aware that information we collect will be transferred to and processed in the United States. By using the Websites or Subscription Service, or providing us with any information, you fully understand and unambiguously consent to this transfer, processing, and storage of your information in the United States, a jurisdiction in which the privacy laws may not be as comprehensive as those in the country where you reside and/or are a citizen.

European Economic Area (EEA) and UK Transfers

Where Personal Data is transferred from the European Economic Area, United Kingdom, or Switzerland to countries not deemed adequate by the European Commission, we ensure appropriate safeguards are in place, including Standard Contractual Clauses approved by the European Commission (as amended or replaced), binding corporate rules, or other lawful transfer mechanisms.

Privacy Shield Notice

While the EU-U.S. Privacy Shield Framework is no longer a valid mechanism for transferring Personal Data from the European Union to the United States, Socialhose continues to comply with the Privacy Shield Principles for all Personal Data received from the European Union and Switzerland in reliance on Privacy Shield prior to its invalidation. We rely on Standard Contractual Clauses for current data transfers.

5. Cookies and Similar Technologies

What Are Cookies?

Cookies are small text files placed on your device to store data that can be recalled by a web server in the domain that placed the cookie. We use cookies and similar technologies for storing and honoring your preferences and settings, enabling you to sign in, providing interest-based advertising, combating fraud, analyzing how our products perform, and fulfilling other legitimate purposes.

Accessing Your Account Information

If you have a Socialhose account, you can access, correct, and update certain Personal Information directly through your account settings. You can also download your data or request account deletion through your account dashboard.

Opting Out of Marketing Communications

You may opt out of receiving promotional communications from us by using the unsubscribe link within each email, updating your email preferences within your Socialhose account settings, or by contacting us directly. If you opt out, we may still send you non-promotional communications, such as those about your account or our ongoing business relations.

Data Retention

We retain Personal Information for as long as necessary to provide the Services, comply with our legal obligations, resolve disputes, and enforce our agreements. When we no longer have a legitimate business need to process your Personal Information, we will either delete or anonymize it, or, if this is not possible, then we will securely store your Personal Information and isolate it from any further processing until deletion is possible.

Complaints

If you are not satisfied with our response to your request or believe our processing of your Personal Information is not in accordance with applicable law, you have the right to lodge a complaint with a supervisory authority in your jurisdiction.

7. California Privacy Rights

California Consumer Privacy Act (CCPA)

If you are a California resident, you have specific rights under the California Consumer Privacy Act (CCPA) regarding your Personal Information. This section describes your CCPA rights and explains how to exercise them.

We Do Not Sell Personal Information

Socialhose does not sell Personal Information received from customers or collected on customers' behalf. We do not retain, use, or disclose Personal Information outside of the direct business relationship with our customers.

In the preceding 12 months, we may have collected the following categories of Personal Information:

  • Identifiers (name, email address, IP address, account name)
  • Commercial information (products or services purchased, purchasing history)
  • Internet or network activity (browsing history, search history, interactions with our Websites)

Exercising Your CCPA Rights

"Shine the Light" Law

California Civil Code Section 1798.83 permits users of our Websites who are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. Additional Information

Children's Privacy

The Websites and Subscription Service are not intended for use by children under the age of 16. We do not knowingly collect Personal Information from children under 16. If we learn that we have collected Personal Information from a child under 16, we will take steps to delete such information.

Our Websites may contain links to other websites that are not operated by us. If you click on a third-party link, you will be directed to that third party's site.
